RESUMO<\/strong><\/p>\n\n\n\n

O presente trabalho objetiva analisar qual a melhor forma de reparar os danos causados pela<\/p>\n\n\n\n

ocorr\u00eancia de discrimina\u00e7\u00e3o algor\u00edtmica em tomada de decis\u00f5es automatizadas por sistemas de Intelig\u00eancia Artificial no \u00e2mbito privado, como nos setores de seguro e no recrutamento de<\/p>\n\n\n\n

emprego. Essa problem\u00e1tica surge em fun\u00e7\u00e3o da carater\u00edstica de autonomia da Intelig\u00eancia<\/p>\n\n\n\n

Artificial, bem como pelo fato dessa tecnologia ser cada vez mais utilizada. O m\u00e9todo utilizado<\/p>\n\n\n\n

foi o dedutivo. Para essa abordagem, o trabalho foi dividido em duas partes: em um primeiro<\/p>\n\n\n\n

momento, foram analisados os aspectos gerais a respeito das decis\u00f5es automatizadas, com<\/p>\n\n\n\n

destaque para as caracter\u00edsticas da Intelig\u00eancia Artificial e as formas de se evitar a ocorr\u00eancia<\/p>\n\n\n\n

de vieses algor\u00edtmicos. Ap\u00f3s, foram examinadas as melhores formas de se reparar os danos<\/p>\n\n\n\n

causados pelo uso de sistemas de Intelig\u00eancia Artificial, com enfoque no risco da atividade<\/p>\n\n\n\n

algor\u00edtmica e nas solu\u00e7\u00f5es discutidas pela doutrina para resolver essa problem\u00e1tica, quais sejam, atrav\u00e9s de seguros obrigat\u00f3rios e fundos de compensa\u00e7\u00e3o e da cria\u00e7\u00e3o de uma personalidade<\/p>\n\n\n\n

jur\u00eddica. Atrav\u00e9s do estudo feito, entende-se que os sistemas de Intelig\u00eancia Artificial n\u00e3o s\u00e3o<\/p>\n\n\n\n

neutros, podendo gerar resultados discriminat\u00f3rios il\u00edcitos e abusivos. Embora existam<\/p>\n\n\n\n

mecanismos para evitar a ocorr\u00eancia de discrimina\u00e7\u00e3o algor\u00edtmica nas decis\u00f5es automatizadas<\/p>\n\n\n\n

previstos na Lei Geral de Prote\u00e7\u00e3o de Dados, como o princ\u00edpio da n\u00e3o discrimina\u00e7\u00e3o e o direito<\/p>\n\n\n\n

\u00e0 revis\u00e3o, por se tratar de uma problem\u00e1tica nova, a chance de haver discrimina\u00e7\u00e3o algor\u00edtmica<\/p>\n\n\n\n

se mostra elevada. Contudo, quanto \u00e0 responsabilidade civil, compreende-se n\u00e3o ser necess\u00e1ria a cria\u00e7\u00e3o de um regramento espec\u00edfico, ao menos no atual est\u00e1gio de desenvolvimento da Intelig\u00eancia Artificial, tendo em vista as cl\u00e1usulas gerais de responsabilidade civil constantes tanto no C\u00f3digo Civil, quanto no C\u00f3digo de Defesa do Consumidor.<\/p>\n\n\n\n

ABSTRACT<\/strong><\/p>\n\n\n\n

The present work aims to analyze the best way to repair the damage caused by the occurrence of algorithmic discrimination in automated decision-making by Artificial Intelligence systems in the private sphere, such as in the insurance sectors and in job recruitment. This problem arises due to the autonomy characteristic of Artificial Intelligence, as well as the fact that this technology is increasingly used. The method used was the deductive reasoning. For this approach, the work was divided into two parts: at first, the general aspects of automated decisions were analyzed, with emphasis on the characteristics of Artificial Intelligence and ways to avoid the occurrence of algorithmic biases. Afterwards, the best ways to repair the damage caused by the use of Artificial Intelligence systems were examined, focusing on the risk of algorithmic activity and on the solutions discussed by the doctrine to solve this problem, namely, through mandatory insurance and compensation funds and the creation of a legal personality. Through the study carried out, it is understood that Artificial Intelligence systems are not neutral and can generate illicit and abusive discriminatory results. Although there are mechanisms to avoid the occurrence of algorithmic discrimination in automated decisions provided for in the General Data Protection Law, such as the principle of non-discrimination and the right to review, as it is a new problem, the chance of algorithmic discrimination appears high. However, regarding civil liability, it is understood that the creation of a specific rule is not necessary, at least in the current stage of development of Artificial Intelligence, in view of the general clauses of civil liability contained both in the Civil Code and in the Code of Defense of the Consumer.<\/p>\n\n\n\n
